This Privacy Policy describes how Acquis Consulting Group, L.L.C. and its affiliates who may elect to follow this Privacy Policy (collectively, “Acquis” or “we,” “us,” or “our”) collect, use and share personal data collected from visitors to our website (located at https://www.acquisconsulting.com) (our “Website”) and through our services, which include consulting, technical and related professional services we provide to our clients (collectively, our “Services”). By using our Website or interacting with us through our Services, you acknowledge that you have read and understood this Privacy Policy. Depending on where you reside and how you interact with Acquis, different sections of this Privacy Policy may apply to you and include additional descriptions of our practices and your legal rights. Your use of our Website or Services constitutes your acceptance to our collection, use, and disclosure of your personal information as described in this Privacy Policy.

Collection of Information

When you use our Website and interact with us through our Services, we may collect information about you. The categories of information we collect as well as descriptions of how Acquis receives, uses and discloses that information are described in the chart below:

How do we use this information?

We use the information and data we collect principally in order to provide our Website and Services. More specifically, we may use your personal information to: 

• Communicate with you regarding our Services and with respect to your questions and requests, including sending you newsletters and alerts

• Operate our Website, provide our Services, and publish content

• Distribute content to you in accordance with your preferences as well as provide other notifications to you (for example, updates about our policies and terms)

• Measure usage of the Website

• If you provide us with a resume or other information related to a job opening, we will use that information to evaluate your submission

• Provide for the safety and security of our Website and Services

• Conduct research and similar activities to improve our Website and services

• Comply with our legal and regulatory responsibilities and enforce our rights

• In any other way we may describe when you provide your information

• For any other purpose with your consent

• Your information may be shared with third-party service providers who support our business operations, including professional advisors, web-hosting providers, analytics providers, customer-relationship management software providers and other similar information technology providers. These service providers are contractually bound to protect your personal information and may only use it for the specific services they provide to us, in accordance with our written data processing agreements and applicable data protection laws. • Any court, governmental authority, law enforcement agency or other third party where we believe disclosure is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights, the rights of any third party or individuals’ personal safety, or to detect, prevent, or otherwise address fraud, security or safety issues.

• To our affiliated entities and in connection with the sale, assignment or other transfer of our company or one of our businesses and of their assets.

• To any other third parties where you have provided your consent.

We partner with Microsoft Clarity to capture how you use and interact with our Website through behavioral metrics, heatmaps, and session replay to improve our services. Microsoft Clarity’s session-recording feature masks form fields and personal information during playback to help protect sensitive data.

Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of services and online activity. We use this information for site performance, site optimization, security/fraud prevention, and indirect user feedback. By accepting the cookies related to these services on our Website, you agree to the recording of the information collected by these services.

We may use third-party lead enrichment services to identify or supplement publicly available business contact information, such as name, company, role, or work email, based on IP addresses, company domains, or other public signals. We use this information to understand business interest in our services and to communicate relevant information or support.

In order to fight spam and abuse on our website, we have implemented reCAPTCHA and the use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Use.

How We Protect Your Information

Acquis implements and maintains appropriate technical and organizational security measures designed to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. We restrict access to user information to those individuals who reasonably need access to perform their job functions. While we strive to protect your personal information, you should understand that no Internet transmission is ever 100% secure or error-free, and you provide your information at your own risk.

Children’s Information

Our Website and services are not directed at children under the age of 16 and we do not knowingly collect personal information from or about children under the age of 16 through our Website and/or services. If you have reason to believe that a child under the age of 16 has provided personal information to us, please notify us by completing a request form, and we will endeavor to delete that information from our databases.

Links to Other Websites

Our Website and services may contain links to other websites. The operators of such other websites may collect information about you, including through cookies or other technologies. If you are using our Website or services and click a link to another site, you will leave our Website and this Privacy Policy will not apply to your use of and activity on those other sites. We encourage you to read the legal notices posted on those sites, including their privacy policies. We are not responsible for the data collection and use practices of such other sites. 

Information for European Residents

• Our Legal Basis for Processing: Under the laws of the European Union (the “EU”), the European Economic Area (“EEA”) and the United Kingdom (the “UK”), we are required to only collect, use and share information about you when we have a lawful basis for doing so. In most instances, we process your personal information in order to perform our contractual obligations. For example, we rely on this legal ground when we use your personal information to administer our relationship with you or your employer in connection with our services. We may also process your personal information in connection with our legitimate interests; for example, in order to market our services to you and to understand and improve our Website, to process your information in connection with job inquiries, and where necessary to protect or defend our or another’s rights or property, or to detect, prevent, or otherwise address fraud, security, safety or privacy issues. Legitimate interests is a term under international laws, such as those of the EU and UK, that means we have good reasons for the processing of your personal information, that you would reasonably expect these uses, and that we take measures to minimize the impact on your privacy. In addition, there may be other situations where other grounds for processing may exist, such as where processing is a result of legal requirements (or for reasons of public interest) or where you consent to such use. Please see the “Your Rights” section of this Privacy Policy below for more information about how you may request that we limit or refrain from processing your personal information.

• Transferring Your Personal Information Internationally: If you are a resident of the EU, EEA or UK, your information may be transferred both within and outside the EEA and the UK (including to the USA). When we transfer your personal information outside the EEA or UK, we will put in place appropriate safeguards in accordance with our legal obligations. These safeguards include Standard Contractual Clauses approved by the European Commission and/or UK authorities, and other appropriate safeguards as required by applicable data protection laws, to ensure that your personal information receives an adequate level of protection when transferred outside the EEA or UK.

Your Rights and Choices

 Depending on your country or state of residence, you may have some or all of the following rights:

• Right of Access/Portability: You can ask to review details about the information we hold about you and how that information has been used and disclosed. You can also request that your personal information is provided to you in a commonly used electronic format so that you can share it with other organizations. 

• Right to Correct Information: You may ask that we make corrections to any inaccurate information we hold, if you believe such correction to be necessary.

• Right to Restrict Our Processing or Erasure of Information: You have the right in certain circumstances to ask us to restrict processing of your personal information or to erase your personal information. Where you have consented to our use of your personal information, you can withdraw your consent at any time.

The above rights may be subject to certain exceptions depending on your country or state of residence and we may require verification of your identity in the event you request such rights, in each instance in compliance with applicable law in your jurisdiction.

We will not discriminate against you if you decide to exercise your privacy rights; however, please note that some aspects of our Website or services may not be available to you if you choose to restrict or otherwise opt out of the sharing of personal information.

In the event that we decline any request by you to exercise any of the above rights, we will let you know why, and you may have the right to file an appeal or complaint with the relevant regulatory authority in your jurisdiction. 

You can make a request to exercise any of these rights by completing a request form.

We will be in contact with you (by email, mail or otherwise) to verify your identity and provide you the information you request. We will respond to your request for access to your personal information within the amount of time required in your jurisdiction of residence.

Please note that Acquis does not use “automatic decision making” or “profiling” as those terms are defined in applicable privacy laws to make decisions that produce legal or similarly significant effects concerning consumers. In addition, in the past 12 months, we have not “sold” Personal Information, including Personal Information of minors under the age of 16. For purposes of this Disclosure, “sold” means the disclosure of Personal Information to a third-party for monetary or other valuable consideration. Acquis also does not “share” Personal Information for cross-context behavioral advertising or targeted advertising.

How Long We Retain Your Information 

We retain your personal information only as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, and to support legitimate operational needs. Our general retention practices are as follows:

• Relationship-Based Retention: Most personal information, including contact and identification information, demographic information, and professional or employment-related information, is retained for as long as you have a relationship with us (e.g., as a client contact, prospective client, job applicant, or service provider), and for a reasonable period thereafter as necessary for our operational purposes, to facilitate re-engagement with Acquis services, and to comply with legal, accounting, and record-keeping obligations.

• Employment and Recruitment Records: Professional and educational information submitted in connection with job applications is retained for the period required by applicable employment laws. In most cases, this means retaining such records for at least four years following the application, though certain records may be retained longer if required by law or if the applicant is hired.

• Technical and Device Data: Internet activity, device information, and geolocation data are generally retained for up to 24 months from your last interaction, after which the data is deleted or anonymized.

• Commercial Information: Records of services you purchased, obtained, or considered are retained for the duration of the business relationship and for a period thereafter as required for legal, tax, and accounting purposes.

• Aggregated and Anonymized Data: Aggregated or anonymized data that cannot be linked to an individual may be retained indefinitely for analytics, research, and service improvement purposes.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. Our data retention schedule with specific retention periods is available upon request.

Information for California Residents (CCPA/CPRA Disclosure)

This section provides additional privacy information for California residents under the California Consumer Privacy Act (“CCPA”) and California Privacy Rights Act (“CPRA”). This supplements the information contained in this Privacy Policy. Under the CCPA, “Personal Information” is information that identifies, relates to, or could reasonably be linked directly or indirectly with a particular California resident. The specific Personal Information that we collect, use, and disclose relating to a California resident covered by the CCPA will vary based on our relationship or interaction with that individual. Terms that are used, but not defined, in this CCPA Disclosure are defined in the CCPA.

Information Collected 

The categories of personal information collected by Acquis include:

• Identifiers

• California Customer Records personal information

• Protected classification characteristics under California or federal law

If you are a California resident, you have the right to:

1. Request we disclose to you free of charge the following information covering the 12 months preceding your request:

   1. the categories of Personal Information about you that we collected;

   2. the categories of sources from which the Personal Information was collected;

   3. the purposes for collecting Personal Information about you;

   4. the categories of third parties to whom we disclosed Personal Information about you and the categories of Personal Information that was disclosed (if applicable) and the purpose for disclosing the Personal Information about you; and

   5. the specific pieces of Personal Information we collected about you;

2. Request we delete Personal Information we collected from you, unless the CCPA recognizes an exception;

3. Be free from unlawful discrimination for exercising your rights under the CCPA; and

4. Request that we correct inaccurate Personal Information we maintain about you.

We will acknowledge receipt of your request within 10 business days and advise you how long we expect it will take to respond if we are able to verify your identity, as required by the CCPA/CPRA. Requests for specific pieces of Personal Information will require additional information to verify your identity. We will work to process all verified requests within 45 days pursuant to the CCPA. If we need an extension for up to an additional 45 days in order to process your request, we will provide you with an explanation for the delay. 

If you submit a request on behalf of another person, we may require proof of authorization and verification of identity directly from the person for whom you are submitting a request. 

In some instances, we may not be able to honor your request, and we will advise you of that fact in our response. For example, we will not honor your request if we cannot verify your identity or if we cannot verify that you have the authority to make a request on behalf of another individual. Additionally, we will not honor your request where an exception applies, such as where the disclosure of Personal Information would adversely affect the rights and freedoms of another consumer or where the Personal Information that we maintain about you is not subject to the CCPA’s access or deletion rights.

How to Exercise Your Rights

Do-Not-Track

Some browsers have incorporated a Do Not Track (DNT) feature. These features, when turned on, send a signal that you prefer that the website you are visiting not collect and use data regarding your online searching and browsing activities. As there is not yet a common understanding on how to interpret the DNT signal, we currently do not respond to DNT signals on our site.

Global Privacy Control and Universal Opt-Out Preference Signals

We honor Global Privacy Control (GPC) and similar universal opt-out preference signals. If your browser or device sends a signal indicating your preference to opt out of the sale or sharing of your personal information or targeted advertising, we will treat that signal as a valid opt-out request. Note that because Acquis does not sell personal information or share personal information for targeted advertising, honoring such signals will not result in any material change to how we process your data. Social Media Features

Our Website may include social media features, such as Facebook, Instagram, X (formerly Twitter), and LinkedIn links. These features may collect your IP address, which page you are visiting on the Website, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our Website. Your interactions with these features are governed by the privacy policy of the company providing them. 

Changes in Our Privacy Policy

We reserve the right to change this Privacy Policy at any time. Please refer to the date at the top of this page to determine when this Privacy Policy was last revised. Any changes to our Privacy Policy will become effective upon posting of the revised policy on the Website. By continuing to use our Website and services following such changes, you will be deemed to have agreed to such changes.
